Terms of Service
Last updated: October 1, 2026
These Terms of Service ("Terms") govern your use of the FlashSaleKit application ("the App") provided by NerdLabs ("we," "us," or "our"). By installing or using FlashSaleKit, you agree to these Terms.
1. Service Description
FlashSaleKit is a Shopify application, embedded in the Shopify admin, that schedules temporary price changes. You choose products (by tag, collection, a list of products, or every active product), a discount, and when the sale runs: once, on chosen days, or every week. When a sale window opens, the App records each variant's price and compare-at price and lowers the price; when it closes, the App puts them back. Every sale is listed on the App's History page, variant by variant.
FlashSaleKit changes only the prices and compare-at prices of the products in the sales you schedule. When a sale ends it puts a price back only if the variant still has the sale price; if you change a price during a sale, your change is kept. It never deletes products, and it never changes your orders, inventory or theme.
2. Account and Eligibility
- You must have an active Shopify store to use FlashSaleKit.
- You must have the authority to grant FlashSaleKit access to your Shopify store.
- You are responsible for the sales you and your staff schedule with the App, including which products are included, the discount, and the times.
- You are responsible for making sure your sales comply with any pricing agreements you have (for example, a supplier's minimum advertised price policy) and with the laws that apply to your store. This includes showing a crossed-out "regular" price: some places regulate how often and how long an item can be shown as discounted from a reference price.
- You are responsible for the security of your Shopify account and for who on your staff can access the App.
3. Pricing and Billing
- FlashSaleKit offers a Free tier, free forever: 1 schedule (one-off windows), up to 100 variants per sale.
- The Micro tier is $3.99/month: up to 5 schedules, repeating windows (chosen days or every week), up to 2,000 variants per sale, and up to 2,000 price changes a month.
- The Pro tier is $7.99/month: unlimited schedules and price changes, up to 10,000 variants per sale.
- A price change is one variant put on sale. Putting prices back never counts toward a limit.
- Paid tiers are billed through Shopify's billing system. A 7-day free trial applies to your first paid subscription.
- You may change or cancel your plan at any time through Shopify. Sales already running finish and their prices are put back whatever your plan.
- We reserve the right to change pricing with 30 days' notice.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose, including deceptive pricing
- Attempt to reverse engineer, decompile, or extract source code from the App
- Use automated systems to scrape or extract data from the App beyond normal use
- Resell, sublicense, or redistribute access to the App
- Interfere with or disrupt the App's infrastructure
5. Data and Privacy
Your use of FlashSaleKit is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described therein. FlashSaleKit reads and writes your products' prices. It does not read orders or customers, and it does not store customer names, emails, phone numbers or addresses.
You retain ownership of all your store data and settings. We claim no ownership rights over your data.
6. Third-Party Services
FlashSaleKit runs on Shopify's platform and APIs. Your use of the App is also subject to the Shopify Terms of Service. We are not responsible for the availability, accuracy, or policies of third-party services.
7. How Sales Run
FlashSaleKit works with the information in your store and Shopify's APIs. While we strive for reliability:
- While the App is running, it starts changing a sale's prices within about a minute of the scheduled start and end. Large sales take longer to finish, because Shopify limits how fast prices can be changed. If the App was not running when a window opened, it starts the sale as soon as it runs again, provided the window is still open; a recent window that passed entirely is recorded as missed in History. If it was not running when a window closed, it puts prices back as soon as it runs again.
- If Shopify does not confirm a sale price, the App reads it back and tries again a few times; a sale price Shopify refuses is shown as failed in History. Price put-backs are retried, with growing pauses, until the price is back or you have changed it yourself.
- Prices can only be put back while the App is installed. If you uninstall the App while a sale is running, those products keep their sale prices; end running sales before uninstalling.
- A product's price that you change during a sale is left as you set it when the sale ends.
- A sale that matches more variants than your plan allows per sale includes the first ones up to that limit, and a sale that reaches a monthly price-change limit stops adding variants; History says so.
8. Limitation of Liability
To the maximum extent permitted by law:
- FlashSaleKit is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
- We are not liable for lost sales, orders placed at sale prices, pricing-agreement disputes, or other business losses arising from the use of, or reliance on, the App.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.
10. Termination
- You may terminate your use at any time by uninstalling the App from your Shopify store.
- We may suspend or terminate your access if you violate these Terms.
- Upon termination, your access tokens are deleted immediately and the data held by the App is deleted when Shopify sends its shop-redaction request (about 48 hours later), per our Privacy Policy. Prices already in your store stay as they are, including those of any sale still running.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes in the App.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
